SmartDesk AI provides an online AI Readiness Assessment tool that evaluates your business's readiness to adopt artificial intelligence automation and generates a personalized report with recommendations. Services include:

To access certain Services, you must provide accurate and complete contact and business information. You are responsible for ensuring that the information you provide is truthful and up to date. SmartDesk AI is not responsible for any errors or omissions resulting from inaccurate information you provide.
By checking the consent checkbox on our assessment form, you provide your express written consent for SmartDesk AI to contact you via email and SMS/text message using automated or pre-recorded technology for marketing, promotional, and informational purposes. This consent is governed by the Telephone Consumer Protection Act (TCPA) and applicable state laws.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SMARTDESK AI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
THE AI READINESS REPORT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. SMARTDESK AI MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR APPLICABILITY OF ASSESSMENT RESULTS TO YOUR SPECIFIC BUSINESS CIRCUMSTANCES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTDESK AI AND ITS OWNER, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF SMARTDESK AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL SMARTDESK AI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICES EXCEED THE AMOUNT YOU PAID TO SMARTDESK AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless SmartDesk AI and its owner, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.
SmartDesk AI reserves the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Services after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
SmartDesk AI reserves the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Wetumpka, Alabama, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmartDesk AI regarding your use of the Services and supersede all prior or contemporaneous understandings, agreements, or communications.
